Liability insurance at school
In addition to accident insurance, liability insurance also plays a role - especially in the event of damage caused or suffered by pupils or teachers.
What is insured?
Damage caused by pupils to other persons or property when acting in the context of school events.
Damage caused by teachers or other supervisors in the course of their official duties.
Damage to school property, unless caused intentionally or through gross negligence.
Example:
A student accidentally knocks a classmate's cell phone off the table during a school trip. The school's liability insurance can settle the claim - depending on the individual case.
Who is insured?
Pupils during lessons, on the way to school and at school events
Teachers and other school staff in the course of their official duties
Volunteers, e.g. parents at school parties or excursions
What is not insured?
Intentional damage
Private activities outside the school setting
Damage that is not related to school operations
Example:
A student willfully damages a door. In this case, he/she (or the parents) is liable - not the school.
Who is the carrier of the liability insurance?
In North Rhine-Westphalia, cover is usually provided by the Municipal Compensation Fund (KSA) or a municipal liability insurance company. The exact responsibility depends on the school authority (e.g. City of Bochum).
What to do in the event of damage?
The damage must be reported to the school immediately. The school will document the incident and inform the responsible insurance company. Parents and pupils should not make any admissions of guilt - this will be clarified by the insurance company.
